Terms & Conditions
1. APPLICATION
1.1 These Terms & Conditions govern the provision of London Luxury Transport services by London Luxury Transport LTD to its Customers.
1.2 These Terms & Conditions represent the entire relationship between London Luxury Transport LTD and its Customers.
1.3 These Terms & Conditions supersede all previous terms and constitute a legally binding agreement.

2. DEFINITIONS
2.1 “Account” means financial credit offered to an Account Customer by the Company on Fares and Additional Charges governed by the Account Special Terms & Conditions.
2.2 “Account Application Form” means the form (or application method) prescribed by the Company to be completed by a Customer for an Account.
2.3 “Account Customer(s)” means any person or business requesting or in receipt of an Account from the Company.
2.4 “Account Special Terms & Conditions” means those provisions governing an Account at Clause 6.
2.5 “Additional Charge(s)” means ancillary monies paid by the Customer (which includes, but is not limited to, surcharges, cancellation charges, parking charges, emission zone charges and congestion charges).
2.6 “Communication Software” means a mobile application, accessed using a Mobile Device, which transmits Private Hire Booking details using telecommunication or navigation software (that is to say software or programs capable of sending and / or receiving data in any form (including, but not limited to, credit or debit card payments, voice telephony, cellular data, wireless data, SMS and MMC messages, digital or analogue radio signals)) licensed or otherwise supplied to the Customer for the performance of a Transportation Service.
2.7 “Company” means London Luxury Transport Limited of 8 St Andrews Square, London, W11 1RH.
2.8 “Customer(s)” means any person who makes a Private Hire Booking, including all associated passengers to that private hire booking, for a Transportation Service.
2.9 “Fare(s)” means the money paid by a Customer for the provision of a Private Hire Booking and Transportation Service.
2.10 “Licensing Authority” means Transport for London (as specified within section 36(b) Private Hire Vehicles (London) Act 1998, section 154 and Schedule 21 Greater London Authority Act 1999).
2.11 “Mobile Device(s)” means a portable wireless handheld device owned by the Customer that enables connection to a telecommunications network for the transmission and receipt of voice, video or other data and can be used in conjunction with the Communication Software.
2.12 “Private Hire Booking(s)” means the same as that defined within section 1(4) Private Hire Vehicles (London) Act 1998.
2.13 “Private Hire Licensing Law” means, but is not limited to, the Private Hire Vehicles (London) Act 1998, Private Hire Vehicles (London) (Operators’ Licences) Regulations 2000, Private Hire Vehicles (London PHV Driver’s Licences) Regulations 2003 and Private Hire Vehicles (London PHV Licences) Regulations 2004.
2.14 “Private Hire Operator” means the same as that defined within section 1(1)(b) Private Hire Vehicles (London) Act 1998.
2.15 “Private Hire Vehicle(s)” means the same as that defined within section 1(1) Private Hire Vehicles (London) Act 1998.
2.16 “Private Hire Vehicle Driver(s)” means the same as that required within section 12 Private Hire Vehicles (London) Act 1998.
2.17 “Terms” means this document and incorporates any other agreements, policies or related documents referenced herein.
2.18 “Transportation Service(s)” means the conveying, using a licensed Private Hire Vehicle driven by a licensed Private Hire Vehicle Driver, a Customer and / or belongings from a collection point to destination point in accordance with a Private Hire Booking made by, for or on behalf of that Customer.

3. NATURE OF RELATIONSHIP – PRIVATE HIRE BOOKING SERVICE(S)
3.1 London Luxury Transport LTD, a licensed Private Hire Operator, accepts Private Hire Bookings.
3.2 The Customer is any person making a Private Hire Booking with the Company.
3.3 London Luxury Transport LTD is principal for the purposes of relevant regulations.

4. COMPANY OBLIGATIONS – PRIVATE HIRE BOOKING SERVICE(S)
4.1 London Luxury Transport LTD will invite and accept Private Hire Bookings in compliance with the law.
4.2 Bookings will be confirmed in accordance with regulatory requirements.
4.3 London Luxury Transport LTD will engage drivers and vehicles for the service.
4.4 The Company determines the performance of the Booking and Service.
4.5 We reserve the right to refuse a Booking or withdraw a Service in compliance with the law.

5. CUSTOMER OBLIGATIONS – PRIVATE HIRE BOOKING SERVICE(S)
5.1 The Customer shall provide accurate booking information.
5.2 The Customer shall pay the Fare and any Additional Charges.
5.3 Additional Charges may include airport parking, cancellation fees, congestion charges, surcharges, etc.
5.4 Payment of Fares and Additional Charges is due upon completion of the Service unless otherwise specified.
5.6 Complaints should be submitted via email to info@londonluxurytransport.co.uk.

6. ACCOUNT(S) – PRIVATE HIRE BOOKING(S)
6.1 Account services offered at the discretion of London Luxury Transport LTD.
6.2 Account Application submission required.
6.3 Account Customers may be extended credit on Fares and Additional Charges.
6.6 Account invoices due within 14 working days of receipt.
6.7 Interest on late payments at 8.6% per day after the specified due date.

7. FORCE MAJEURE
7.1 Both the Company and the Customer shall promptly inform the other of any force majeure events and keep each other informed of any developments.
7.2 London Luxury Transport LTD is not liable for breaches due to events beyond its control, such as severe weather, strikes, or civil unrest.
7.3 The Company is not liable for any delay or non-performance due to force majeure.

8. INSURANCE
8.1 London Luxury Transport LTD maintains all necessary insurance policies as required by law.
8.2 The Customer is responsible for ensuring appropriate insurance coverage for any goods transported.

9. INTELLECTUAL PROPERTY
9.1 These Terms do not transfer any ownership rights of materials or Communication Software provided by the Company.
9.2 The Company retains ownership of all materials and Communication Software under the Copyright, Designs and Patents Act 1988.

10. DATA PROTECTION
10.1 The Company complies with the General Data Protection Regulation (GDPR) as incorporated by the Data Protection Act 2018.
10.2 A copy of the Company’s Privacy Policy is available to Customers.

11. PRICE OF SERVICES
11.1 The prices of the Services will be as quoted. We take all reasonable care to ensure that the prices of Services are correct at the time when the relevant information was provided.
11.2 Additional charges
11.2(a) All car park/parking charges are passed on at cost.
11.2(b) Terminal drop-off charges will be passed on at cost.
11.3 Prices for our Services may change from time to time, but changes will not affect any order which we have confirmed with a Booking Confirmation
11.4 The price of the Services includes VAT (where applicable) at the applicable current rate chargeable in the UK.
11.5 For any special requests such as a multi-lingual driver, custom labelling of the vehicle, stopovers, oversize luggage, and child safety seats, we reserve the right to charge supplemental fees. In case of changes made once a journey has started (e.g. change to the distance or amount of hours) the price for the actual total distance or hours will be calculated and charged after the completion of the ride in accordance with our applicable rates. If a journey is shorter than the distance or number of hours originally booked, the original amount will be charged.
11.6 In the case of hourly bookings: additional miles are charged beyond the miles that are already included in the hourly booking (10 miles within London). Each additional mile will be charged at the “Excess Mileage Rate” for each vehicle group plus the applicable VAT (£2.50 per mile).
Passenger collection
11.7 We are happy to provide a ‘Meet & Greet Service’ at airports, ports and train stations. The driver will be waiting at arrivals with the passenger’s name displayed on a name board. If we are unable to locate passengers at the pick-up point, every effort will be made to rectify this before the vehicle is called off. Where we have followed the instructions on a booking, no refund will be made for aborted pick-ups.
11.8 The first 30 minutes of waiting time are free for all pickups. Additional waiting time over 30 minutes will be charged at the £1.25/min for each vehicle group plus the applicable VAT.
11.9 For home address pick-ups, we will wait 30 minutes maximum after the agreed pickup time, during which we will try to contact the number given to us on the booking and expect you to do likewise. If we are unable to make contact with the passenger (ringing the doorbell and calling the contact phone number) the driver will be called away and the passenger will be responsible for the full cost.
11.10 The first 30 minutes of waiting time are free for airport, port and train station pickups (this is a part of the ‘Meet and Greet Service’). Additional waiting time over 30 minutes will be charged at the £1.25/min for each vehicle group plus the applicable VAT
11.11 No-Shows without cancellation will be charged at 100%. A No-Show is a ride in which the passenger does not appear at the agreed pickup location within 30 minutes after the pickup time unless it is unavoidably delayed (e.g., flight, cruise or train delay)

12. CANCELLATIONS AND CHANGES TO BOOKINGS
12.1 Please contact us by email or telephone as soon as possible to make any changes or cancel a booking after you have received the final booking confirmation. Any amendments or cancellations will be confirmed by an email from us to the address entered at the time the booking was created by you.
12.2 In the event of cancellation of a booking the following charges apply:
12.3 If a booking is cancelled between 12 and 24 hours before the scheduled start time, the client will be charged 50% of the agreed-upon booking price.
12.4 If a booking is cancelled less than 12 hours before the scheduled start time, the client will be charged the full amount of the agreed-upon booking price.
12.5 If a booking for any type of major event is cancelled within 7 days of the commencement of the period of hire, the client will be charged the full amount of the agreed-upon booking price.
12.6 If a specific driver is put on hold, as per the client’s request, for a booking which is later cancelled, the client will be charged the full amount of the agreed-upon booking price if they fail to give us 7-days’ notice.
12.7 If the Customer cancels multiple bookings (for multiple days or multiple vehicles) within 7 days of the start of the period of hire, the client will be charged the full amount of the agreed-upon booking price.
12.8 All payments made are non-refundable if the passenger fails to show up at the designated pickup time and location.
13. Payment Terms & Conditions
13.1 All our prices are subject to VAT at the standard rate of 20%.
13.2 Full payment is required before any bookings can be confirmed. For online bookings, the total amount will be charged automatically by London Luxury Transport at the time of booking.
13.3 We accept most major credit or debit cards, including American Express. For BACS transfers, funds must be received prior to the booking date.
13.4 A 25% deposit is required for wedding bookings at the time of booking, with the remaining balance due 14 days before the service date.
13.5 Any changes resulting in additional costs (such as extended waiting time, extra hours, parking fees, or address changes) will be automatically charged to the credit card used at booking.
13.6 Charges will appear on your statement as ‘London Luxury Transport Ltd’.
13.7 We may pre-authorize your credit card to ensure sufficient funds are available for your booking.
13.8 Customers can link multiple credit cards to their personal or business account. You can select your preferred card for each booking. If the primary card cannot be charged, another linked card will be used.

14. HEALTH & SAFETY
14.1 All passengers must wear seat belts.
14.2 Our vehicles have the capacity for carrying passengers and luggage as set out below. A child counts as one passenger. Please note that all luggage must be placed in the boot/trunk and not on seats (please consider your amount of luggage when selecting vehicle type.)

Saloon cars (Business Class and First Class): Capacity to comfortably accommodate up to 3 passengers & 2 average-size luggage

Business MPV: Capacity to comfortably accommodate up to 5 passengers & 5 average-size luggage

Luxury MPV: Capacity to comfortably accommodate up to 7 passengers & 7 average-size luggage

14..3 Average suitcase sizes are 25 x 44 x 67 cm or 10 x 17 x 26 inches.
14.4 Animals: No animal may be carried without prior consent and this will usually be restricted to domestic animals housed securely in a suitable carrying case that is in good repair. Guide dogs and hearing dogs will be carried provided we are given a minimum of 48 hours’ notice.
14.5 As a Private Hire Company, the law regarding the supply of child seats applies.
14.6 A request for a child seat must be made at the time of booking.
14.7 While every effort will be made to fulfil a request, failure to do so does not constitute a breach of contract.
14.8 If you do not request a child seat at the time of booking and wish to use your own, you will remain responsible for it and must remove it from the vehicle at the destination. You remain responsible for the storage of your own child seat at the airport if you do not take it with you on your onward journey.
14.9 If you use your own child seat, you remain responsible for fitting it correctly and safely in our vehicle and you must remove the child seat at the destination without damage to the interior of the vehicle.
14.10 Fitness to travel: Any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat to the driver, the vehicle or other passengers may be refused travel.
14.11 Damage to vehicles: If, as a result of passengers’ actions, a vehicle is damaged or soiled, the person who made the booking will be charged for restoring the vehicle and for losses incurred whilst the vehicle was unusable.
14.12 A strict no smoking policy applies to all our vehicles.
